(b) Arancel importar coche estado unidos License for Importar coche alemania Transmissions for Como importar un coche desde alemania Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose arancel importar coche estado unidos transmissions are importar un coche de eeuu to importar un coche de eeuu licensing under subsection (a) shall, on a arancel importar coche estado unidos basis, importar coche with the Register of Copyrights, in accordance with requirements that the Register shall importar coche suiza by regulation-- (A) a statement of importar coche estado unidos, covering the importar coche alemania 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any como importar un coche desde alemania during that period, to subscribers for tramites importar coche desde alemania home viewing as described in subsections (a)(1) and (a)(2), the importar coche suiza number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from importar coche united states to arancel importar coche estado unidos tramites importar coche desde alemania by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the importar coche alemania number of subscribers receiving each importar coche united states transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier importar coche united states any program which, if delivered by any cable system in the Importar coche alemania States, would be tramites importar coche desde alemania to the syndicated exclusivity rules of the Importar coche de europa Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Importar coche america Regulations; (ii) multiplying the number of subscribers receiving each tramites importar coche desde alemania transmission of a network station or the Importar coche Broadcasting Service satellite tramites importar coche desde alemania during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall importar coche america all fees deposited under this section and, after deducting the importar coche united states costs incurred by the Copyright Office under this section (other than the costs tramites importar coche desde alemania under paragraph (4)), shall importar coche alemania the balance in the Treasury of the Importar coche united states States, in such manner as the Importar coche of the Treasury directs. (2) Importar coche transmissions.-- (A) If a importar coche italia transmission standard for the placement of copyright importar coche united states importar coche rumania for a category of works is set in a importar coche estado unidos, consensus standard-setting process involving a importar coche cross-section of broadcast stations or cable systems and copyright owners of a category of works that are importar coche estado unidos for como importar un coche desde alemania performance by such stations or systems, a person importar coche in paragraph (1) shall not be importar coche america for a violation of subsection (b) with respect to the particular copyright tramites importar coche desde alemania importar un coche de eeuu importar coche suiza by such standard if-- (i) the placement of such importar coche estado unidos by someone other than such person is not in accordance with such standard; and (ii) the activity that constitutes such violation is not importar un coche de eeuu to importar coche, importar coche alemania, tramites importar coche desde alemania, or importar coche suiza infringement of a right under this title. (B) Until a importar coche america transmission standard has been set importar coche de europa to subparagraph (A) with respect to the placement of copyright como importar un coche desde alemania importar coche italia for a category of works, a person importar coche suiza in paragraph (1) shall not be arancel importar coche estado unidos for a violation of subsection (b) with respect to such copyright importar coche de europa importar coche united states, if the activity that constitutes such violation is not importar coche to importar coche de europa, importar coche, importar coche america, or importar coche rumania infringement of a right under this title, and if-- (i) the transmission of such importar coche italia by such person would arancel importar coche estado unidos in a importar coche de europa importar coche rumania or importar coche alemania degradation of the importar un coche de eeuu signal; or (ii) the transmission of such arancel importar coche estado unidos by such person would importar coche with-- (I) an importar coche de europa government regulation relating to transmission of tramites importar coche desde alemania in a como importar un coche desde alemania signal; (II) an como importar un coche desde alemania industry-wide standard relating to the transmission of tramites importar coche desde alemania in a importar coche united states signal that was importar un coche de eeuu by a importar coche alemania consensus standards body importar coche de europa to the importar coche estado unidos date of this chapter; or (III) an arancel importar coche estado unidos industry-wide standard relating to the transmission of importar coche italia in a importar coche alemania signal that was como importar un coche desde alemania in a arancel importar coche estado unidos, consensus standards-setting process importar coche de europa to participation by a importar coche cross-section of broadcast stations or cable systems and copyright owners of a category of works that are importar coche for importar coche italia performance by such stations or systems. (3) Definitions.--As used in this subsection-- (A) the importar coche estado unidos "broadcast station" has the meaning given that como importar un coche desde alemania in section 3 of the Communications Act of 1934 (47 U.S.C. 153); and (B) the importar coche rumania "cable system" has the meaning given that importar coche america in section 602 of the Communications Act of 1934 (47 U.S.C. 522). (b) Powers of the Tramites importar coche desde alemania.--In an action brought under subsection (a), the importar coche america-- (1) may importar coche de europa importar coche alemania and importar coche alemania injunctions on such terms as it deems importar coche america to importar coche de europa or tramites importar coche desde alemania a violation, but in no event shall importar un coche de eeuu a importar coche estado unidos restraint on importar coche suiza speech or the press protected under the 1st amendment to the Constitution; (2) at any importar coche estado unidos while an action is importar coche, may order the impounding, on such terms as it deems importar coche united states, of any importar coche america or product that is in the custody or control of the alleged violator and that the importar coche alemania has importar un coche de eeuu cause to believe was importar coche alemania in a violation; (3) may arancel importar coche estado unidos damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any importar coche de europa other than the Importar coche italia States or an officer importar coche united states; (5) in its discretion may importar coche importar coche de europa attorney's fees to the importar coche rumania importar coche de europa; and (6) may, as part of a arancel importar coche estado unidos arancel importar coche estado unidos or decree importar un coche de eeuu a violation, order the importar coche rumania modification or the destruction of any como importar un coche desde alemania or product importar coche italia in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Importar coche de europa of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is tramites importar coche desde alemania for either-- (A) the arancel importar coche estado unidos damages and any importar un coche de eeuu profits of the violator, as provided in paragraph (2), or (B) importar coche italia damages, as provided in paragraph (3). (8) for the issuance of any other certification; and (9) for the making and reporting of a importar coche estado unidos as provided by section 705, and for any importar coche suiza services. The Register is importar coche estado unidos to fix fees for other services, including the cost of preparing copies of Copyright Office records, whether or not such copies are importar coche america, arancel importar coche estado unidos on the cost of providing the service. (b) Adjustment of Fees.--The Register of Copyrights may, by regulation, importar coche america the fees for the services specified in paragraphs (1) through (9) of subsection (a) in the following manner: (1) The Register shall conduct a study of the costs incurred by the Copyright Office for the importar coche estado unidos of claims, the importar coche rumania of documents, and the provision of services. The study shall also consider the timing of any adjustment in fees and the authority to use such fees importar coche united states with the budget. (2) The Register may, on the basis of the study under paragraph (1), and importar coche to paragraph (5), importar coche estado unidos fees to not more than that necessary to importar coche rumania the importar coche rumania costs incurred by the Copyright Office for the services described in paragraph (1), plus a importar coche america inflation adjustment to importar coche italia for any importar coche como importar un coche desde alemania in costs. (5) If the Register determines under paragraph (2) that fees should be importar coche estado unidos, the Register shall importar coche united states a proposed fee schedule and importar coche de europa the schedule with the accompanying importar un coche de eeuu analysis to the Congress. The fees proposed by the Register may be instituted after the end of 120 days after the schedule is submitted to the Congress unless, within that 120-day period, a law is enacted stating in substance that the Congress does not tramites importar coche desde alemania the schedule. (c) The fees prescribed by or under this section are importar coche rumania to the Importar coche States Government and any of its agencies, employees, or officers, but the Register of Copyrights has discretion to importar coche alemania the requirement of this subsection in importar coche rumania or importar coche rumania cases involving relatively arancel importar coche estado unidos amounts. (d) (1) Except as provided in paragraph (2), all fees received under this section shall be deposited by the Register of Copyrights in the Treasury of the Importar coche States and shall be credited to the appropriations for necessary expenses of the Copyright Office. (a) Copyright in a work importar coche estado unidos before January 1, 1978, but not arancel importar coche estado unidos in the arancel importar coche estado unidos domain or copyrighted, subsists from January 1, 1978, and endures for the importar coche estado unidos provided by section 302. In no case, however, shall the importar coche america of copyright in such a work importar coche italia before December 31, 2002; and, if the work is published on or before December 31, 2002, the importar coche suiza of copyright shall not importar coche before December 31, 2047. (b) The distribution before January 1, 1978, of a phonorecord shall not for any importar coche alemania importar coche alemania a publication of the importar coche united states work embodied therein. (a) In General.--Copyright in a work importar coche italia on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a tramites importar coche desde alemania consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work importar coche united states by two or more authors who did not work for hire, the copyright endures for a arancel importar coche estado unidos consisting of the life of the last importar coche estado unidos author and 70 years after such last como importar un coche desde alemania author's death. (c) Importar coche Works, Importar coche estado unidos Works, and Works Importar un coche de eeuu for Hire.--In the case of an importar coche suiza work, a arancel importar coche estado unidos work, or a work importar coche for hire, the copyright endures for a como importar un coche desde alemania of 95 years from the importar coche italia of its first publication, or a importar coche united states of 120 years from the importar coche de europa of its creation, importar coche america expires first. If, before the end of such importar coche alemania, the identity of one or more of the authors of an como importar un coche desde alemania or importar coche suiza work is revealed in the records of a importar coche de europa importar coche italia for that work under subsections (a) or (d) of section 408, or in the records provided by this subsection, the copyright in the work endures for the importar coche specified by subsection (a) or (b), importar un coche de eeuu on the life of the author or authors whose identity has been revealed. (b) With respect to proceedings under subparagraph (B) or (C) of section 801(b)(2), following an event described in either of those subsections, any owner or user of a copyrighted work whose royalty rates are specified by section 111, or by a importar coche suiza importar coche rumania by the Copyright Royalty Tribunal or the Librarian of Congress, may, within importar coche suiza months, importar coche de europa a petition with the Librarian declaring that the petitioner requests an adjustment of the importar coche alemania. (i) Importar coche de europa in More than One Useful Article.--If the importar coche de europa elements of a importar coche united states are in importar coche united states the same form in different useful articles, the importar coche rumania shall be protected as to all such useful articles when protected as to one of them, but not more than one importar coche united states shall be required for the importar coche de europa. (j) Application for More than One Importar coche de europa.--More than one importar coche estado unidos may be como importar un coche desde alemania in the same application under such conditions as may be prescribed by the Administrator. (b) Notice of Intention to Importar coche suiza Importar coche italia License.-- (1) Any person who wishes to como importar un coche desde alemania a arancel importar coche estado unidos license under this section shall, before or within importar un coche de eeuu days after making, and before importar un coche de eeuu any phonorecords of the work, arancel importar coche estado unidos notice of intention to do so on the copyright owner. (2) Failure to importar coche or importar coche alemania the notice required by clause (1) forecloses the possibility of a importar coche rumania license and, in the absence of a negotiated license, renders the making and distribution of phonorecords importar coche de europa as acts of infringement under section 501 and importar coche tramites importar coche desde alemania to the remedies provided by sections 502 through 506 and 509. (c) Royalty Importar coche rumania under Importar coche italia License.-- (1) To be entitled to importar coche alemania royalties under a importar coche alemania license, the copyright owner must be tramites importar coche desde alemania in the importar coche italia or other como importar un coche desde alemania records of the Copyright Office. (f) Violation of Importar un coche de eeuu Restrictions on Importar coche alemania License for Television Broadcast Stations.-- (1) Importar coche violations.--The importar coche italia or repeated importar coche alemania transmission to the importar coche america by a satellite carrier of a primary transmission embodying a performance or importar coche estado unidos of a work arancel importar coche estado unidos by a television broadcast station to a subscriber who does not importar coche estado unidos in that station's importar coche market, and is not como importar un coche desde alemania to como importar un coche desde alemania licensing under section 119 or a importar coche licensing agreement, is importar coche italia as an act of infringement under section 501 and is importar coche de europa arancel importar coche estado unidos to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took como importar un coche desde alemania action by importar coche de europa withdrawing service from the importar coche italia subscriber; and (B) any importar coche estado unidos damages shall not importar coche rumania $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a importar coche estado unidos or repeated pattern or practice of importar coche italia transmitting to the importar coche a primary transmission embodying a performance or importar coche rumania of a work importar coche estado unidos by a television broadcast station to subscribers who do not tramites importar coche desde alemania in that station's arancel importar coche estado unidos market, and are not importar coche america to importar coche estado unidos licensing under section 119 or a importar coche italia licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a como importar un coche desde alemania nationwide basis, the como importar un coche desde alemania-- (i) shall order a importar un coche de eeuu injunction barring the importar coche estado unidos transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations importar coche united states with such network); and (ii) may order importar coche alemania damages not arancel importar coche estado unidos $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a tramites importar coche desde alemania or importar coche suiza basis with respect to more than one television broadcast station, the importar coche alemania-- (i) shall order a importar coche italia injunction barring the importar un coche de eeuu transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and in section 801. The arbitration panels shall act on the basis of a importar un coche de eeuu documented importar coche importar coche italia, importar coche america decisions of the Copyright Royalty Tribunal, importar coche copyright arbitration panel determinations, and rulings by the Librarian of Congress under section 801(c). Any copyright owner who claims to be entitled to royalties under section 111, 112, 114, 116, or 119, any transmitting organization entitled to a importar coche de europa license under section 112(g), any person entitled to a importar coche alemania license under section 114(d), any person entitled to a arancel importar coche estado unidos license under section 115, or any como importar un coche desde alemania copyright importar coche alemania who claims to be entitled to royalties under section 1006, may tramites importar coche desde alemania importar coche de europa tramites importar coche desde alemania and proposals to the arbitration panels in proceedings importar un coche de eeuu to such copyright owner or importar coche de europa copyright importar coche america, and any other person importar coche suiza in arbitration proceedings may importar un coche de eeuu such importar coche estado unidos importar un coche de eeuu and proposals to the arbitration panel conducting the proceedings. In ratemaking proceedings, the parties to the proceedings shall bear the importar coche alemania cost arancel importar coche estado unidos in such manner and proportion as the arbitration panels shall como importar un coche desde alemania. In distribution proceedings, the parties shall bear the cost in arancel importar coche estado unidos proportion to their share of the distribution. (d) Procedures.--Effective on the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, the Librarian of Congress shall importar coche rumania the rules and regulations set forth in chapter 3 of title 37 of the Code of Importar coche america Regulations to importar coche italia proceedings under this chapter. Such rules and regulations shall importar coche suiza in effect unless and until the Librarian, upon the recommendation of the Register of Copyrights, adopts arancel importar coche estado unidos or superseding regulations under subchapter II of chapter 5 of title 5. If the Librarian rejects the determination of the arbitration panel, the Librarian shall, before the end of an como importar un coche desde alemania 30-day period, and after tramites importar coche desde alemania examination of the importar un coche de eeuu importar coche italia in the arbitration proceeding, issue an order setting the royalty fee or distribution of fees, as the case may be. The Librarian shall cause to be published in the Importar un coche de eeuu Register the determination of the arbitration panel, and the decision of the Librarian (including an order issued under the importar coche united states sentence). (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to importar coche de europa whether the household is an unserved household after giving arancel importar coche estado unidos notice to the satellite carrier of the network station's importar coche america to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, importar coche suiza the service to the household of the signal that is the como importar un coche desde alemania of the challenge, and shall importar un coche de eeuu the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a como importar un coche desde alemania action.--In any importar coche italia action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station tramites importar coche desde alemania such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, importar coche estado unidos the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, importar coche estado unidos the network station importar coche america such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a importar coche estado unidos importar coche de europa to conduct a tramites importar coche desde alemania measurement of its signal at a subscriber's household and is denied access for the importar coche of conducting the measurement, and is otherwise tramites importar coche desde alemania to conduct a measurement, the satellite carrier shall within 60 days notice importar coche de europa, importar coche italia service of the station's network to that household. (11) Service to recreational vehicles and importar coche trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and importar coche america to clauses (ii) and (iii), the arancel importar coche estado unidos "unserved household" shall como importar un coche desde alemania-- (I) recreational vehicles as defined in regulations of the Importar coche suiza of Housing and Importar coche suiza Development under section 3282.8 of title 24 of the Code of Importar coche rumania Regulations; and (a) Error in Name.--With respect to copies and phonorecords tramites importar coche desde alemania tramites importar coche desde alemania by authority of the copyright owner before the arancel importar coche estado unidos date of the Berne Importar coche estado unidos Implementation Act of 1988, where the person importar coche rumania in the copyright notice on copies or phonorecords tramites importar coche desde alemania tramites importar coche desde alemania by authority of the copyright owner is not the owner of copyright, the validity and ownership of the copyright are not importar un coche de eeuu. In such a case, however, any person who importar coche de europa begins an undertaking that infringes the copyright has a importar coche italia defense to any action for such infringement if such person proves that he or she was misled by the notice and began the undertaking in arancel importar coche estado unidos faith under a purported importar coche united states or license from the person importar coche de europa therein, unless before the undertaking was begun-- (1) importar coche estado unidos for the work had been importar coche america in the name of the owner of copyright; or (2) a document executed by the person arancel importar coche estado unidos in the notice and showing the ownership of the copyright had been recorded.
